Terms and conditions

Bookings

  • Sessions will take place on the dates agreed via Zoom, Google Meet or Teams depending on your requirements

 

  • I use a secure booking system platform called Acuity and all of your bookings will be registered here.

Cancellations

  • There is a 28 day cancellation policy. Any sessions cancelled within this time frame will be charged the full fee.

Liability, Indemnity and Insurance

  • The Service Provider shall ensure that it has in place at all times suitable and valid insurance that shall include public liability insurance.

  • In the event that the Service Provider fails to perform the Services with reasonable care and skill it shall carry out any and all necessary remedial action at no additional cost to the Client.

  • The Service Provider’s total liability for any loss or damage caused as a result of its negligence or breach of the Agreement shall be limited to the sum defined therein.

  • The Service Provider shall not be liable for any loss or damage suffered by the Client that results from the Client’s failure to follow any instructions given by the Service Provider.

  • Nothing in these Terms and Conditions nor in the Agreement shall limit or exclude the Service Provider’s liability for death or personal injury.

  • The Service Provider shall indemnify the Client against any costs, liability, damages, loss, claims or proceedings arising out of the Service Provider’s breach of the Agreement.

  • The Client shall indemnify the Service Provider against any costs, liability, damages, loss, claims or proceedings arising from loss or damage to any equipment (including that belonging to any third parties appointed by the Service Provider) caused by the Client or its agents or employees.

  • Neither Party shall be liable to the other or be deemed to be in breach of the Agreement by reason of any delay in performing, or any failure to perform, any of that Party’s obligations if the delay or failure is due to any cause beyond that Party’s reasonable control.

 

Force Majeure

  • No Party to the Agreement shall be liable for any failure or delay in performing their obligations where such failure or delay results from any cause that is beyond the reasonable control of that Party.  Such causes include, but are not limited to: power failure, internet service provider failure, industrial action, civil unrest, fire, flood, storms, earthquakes, acts of terrorism, acts of war, governmental action or any other event that is beyond the control of the Party in question.

 

 

Intellectual property

All materials provided by us are owned by Elemental Health Ltd. Handouts are clearly marked for use and can be shared within your network provided no part of the image or text is changed, edited or altered in any way. Slides are for individual use only. Any other use is strictly prohibited and will constitute an infringement of these terms and conditions and other intellectual property rights of Elemental Health Ltd.

Payment

  • Payment is via invoice and is due within one month of the session taking place. Payment can be made by bank transfer or bank card. Invoices are sent from Xero accountancy software

Accessibility

  • In order to ensure accessibility please fill in the 'Accessibility requirements' section of the booking form and tell us what you need to access the course.

  • Some examples might be: wheelchair access or a disabled parking space for face to face training, hearing loop

Your course materials

Course materials are available in different formats. To choose the format of your course materials, please fill in the 'Accessibility requirements' section of the booking form when you book.

Some examples are; large print. materials are provided in PDF format which is compatible with accessible technologies. If you require the slide deck in advance due to accessibility requirements, please put this on your booking form.
