These Terms and Conditions govern the use of the Elemental Health Ltd Thinkific platform pages (the "Site"). This Site is owned and operated by Elemental Health Ltd, a company registered in England and Wales, of which Angela McMillan is Director.
The Site is an e-commerce website selling digital course content.
By using this Site, you indicate that you have read and understood these Terms and Conditions and agree to abide by them at all times. These Terms and Conditions contain a dispute resolution clause that affects your rights about how disputes are resolved. Please read it carefully.
Intellectual Property
All content published and made available on our Site is the property of Elemental Health Ltd and the Site's creators. This includes, but is not limited to, images, text, logos, documents, downloadable files, and anything that contributes to the composition of our Site.
Acceptable Use
As a user of our Site, you agree to use our Site legally, not to use our Site for illegal purposes, and not to:

We reserve the right to suspend or terminate your account if you are using our Site illegally or if you violate these Terms and Conditions.
Sale of Goods
These Terms and Conditions govern the sale of goods available on our Site. The only good currently available on our Site is a Digital Course Download.
We are under a legal duty to supply goods that match the description of the goods you order on our Site.
These Terms and Conditions apply to all goods displayed on our Site at the time you access it. All information, descriptions, or images we provide about our goods are as accurate as possible. However, we cannot guarantee the accuracy of all goods we provide, and you agree to purchase goods from our Site at your own risk.
We reserve the right to modify, reject, or cancel your order whenever it becomes necessary. If we cancel your order and have already processed your payment, we will give you a refund equal to the amount you paid. It is your responsibility to monitor your payment instrument to verify receipt of any refund.

When you provide us with your payment information, you authorise our use of and access to the payment instrument you have chosen to use, and you authorise us to charge the amount due to this payment instrument. If we believe your payment has violated any law or these Terms and Conditions, we reserve the right to cancel or reverse your transaction.
Right to Cancel and Receive Reimbursement
If you are a customer living in the United Kingdom or the European Union, you have the right to cancel your contract to purchase goods from us within 14 days without giving a reason.
The cancellation period ends 14 days from the date of purchase, since the goods sold on this Site are digital content not supplied on a tangible medium.
To exercise your right to cancel, you must inform us of your decision to cancel within the cancellation period. To cancel, contact us by email at contact@ehe.org.uk or by post at 43 Charles Street, Cardiff, CF10 2GB. You may use a copy of the Cancellation Form found at the end of these Terms and Conditions, but you are not required to do so.
The right to cancel does not apply to custom or personalised goods, goods that will deteriorate or expire rapidly, and goods or services where the price depends on financial market fluctuations we cannot control.
Effects of Cancellation
If you give express consent to the supply of digital content during the cancellation period and acknowledge that your right to cancel is lost once that digital content is supplied, you will no longer have the right to cancel the contract.
Where you remain entitled to cancel, we will make the reimbursement using the same form of payment as you used for the initial purchase, unless you have expressly agreed otherwise. You will not incur any fees as a result of the reimbursement.
This right to cancel and to reimbursement is not affected by any separate return or refund policy we may have.
Consumer Protection Law
Where the Consumer Rights Act 2015 or any other consumer protection legislation in your jurisdiction applies and cannot be excluded, these Terms and Conditions will not limit your legal rights and remedies under that legislation. These Terms and Conditions are read subject to the mandatory provisions of that legislation. If there is a conflict between these Terms and Conditions and that legislation, the mandatory provisions of the legislation apply.
Data Protection
Elemental Health Ltd is a registered data controller with the Information Commissioner's Office, registration number ZA368412. Personal information collected through your account and purchases on this Site is handled in line with UK GDPR and the Data Protection Act 2018, as set out in our Privacy Notice.
If you have a concern about how your data has been collected, used, or stored, please raise this with us directly by email to contact@ehe.org.uk. We will acknowledge your concern within 5 working days, investigate, and aim to respond with the outcome within 20 working days. If you are not satisfied with how your concern has been handled, you have the right to complain to the Information Commissioner's Office at www.ico.org.uk.
Our Use of AI
Any use of AI tools by Elemental Health Ltd in connection with this Site is limited to things like editing marketing copy and business planning. We do not use AI to assess, personalise, or respond to individual course purchases, accounts, or communications.
About Our Training Content
Elemental Health Ltd's digital courses are developed and delivered by Angela McMillan, an accredited member of the British Association for Counselling and Psychotherapy (BACP), and are informed by the BACP Ethical Framework for the Counselling Professions.
Nothing in this training is designed to replace professional medical help. Please seek the support of a medical practitioner before applying any of the approaches covered.
Limitation of Liability
Elemental Health Ltd and our directors, officers, agents, employees, subsidiaries, and affiliates will not be liable for any actions, claims, losses, damages, liabilities, and expenses, including legal fees, arising from your use of the Site.
Indemnity
Except where prohibited by law, by using this Site you indemnify and hold harmless Elemental Health Ltd and our directors, officers, agents, employees, subsidiaries, and affiliates from any actions, claims, losses, damages, liabilities, and expenses, including legal fees, arising out of your use of our Site or your violation of these Terms and Conditions.
Applicable Law
The laws of England and Wales govern these Terms and Conditions.
Dispute Resolution
Subject to any exceptions specified in these Terms and Conditions, if you and Elemental Health Ltd are unable to resolve a dispute through informal discussion, you both agree to submit the issue first to a non-binding mediator, and to an arbitrator if mediation fails. The decision of the arbitrator will be final and binding. Any mediator or arbitrator must be a neutral party acceptable to both parties.
Nothing in these Terms and Conditions affects your right to bring an action in the small claims court, or to bring an action for injunctive relief or intellectual property infringement.
Severability
If any provision of these Terms and Conditions is found to be inconsistent or invalid under applicable law, that provision will be removed, and all other provisions will remain valid and unaffected.
Changes
These Terms and Conditions may be amended from time to time to maintain compliance with the law and to reflect changes to how we operate our Site. We will notify users by email of any changes, or post a notice on our Site.
